Resumen de El Decreto Legislativo en la encrucijada

El presente texto pretende tomar el pulso jurídico a una figura algo olvidada en nuestra praxis constitucional como es el Decreto Legislativo. Para ello, primero se recordarán algunos aspectos introductorios y se analizarán determinados aspectos históricos y comparados, que demuestran la raigambre de la figura en nuestra Historia constitucional así como su plasmación en sistemas constitucionales vecinos. Posteriormente se aborda el análisis en profundidad de la regulación constitucional de la institución, con especial referencia a su estado y evolución actual. Acto seguido prestamos atención a sus sistemas de control, donde nada ha variado a la luz de los últimos (y muy escasos) pronunciamientos jurisdiccionales más recientes. Finalizamos con una conclusión final que apuesta por revitalizar el Decreto Legislativo y que este no se vea abocado a convertirse en una norma irrelevante.

This text intends to take the legal pulse of a forgotten figure in our constitutional practice such as the Legislative Decree. To do this, first some introductory aspects will be recalled and certain historical and comparative aspects will be analyzed, which demonstrate the roots of the figure in our Constitutional History as well as its expression in neighboring constitutional systems. Subsequently, the in-depth analysis of the constitutional regulation of the institution is addressed, with special reference to its current state and evolution. We then pay attention to their control systems, where nothing has changed in light of the latest (and very few) most recent jurisdictional pronouncements. We conclude with a final point that is committed to revitalizing the Legislative Decree and that it is not doomed to become an irrelevant norm.
