Resumen de La punibilidad del comportamiento del mulero o phisher-mule en derecho penal español: análisis de la sentencia del tribunal supremo 834/2012 de 25 de octubre

  El trabajo expone una propuesta de solución a un problema que se presenta con no poca frecuencia en la jurisprudencia: determinar bajo qué tipo penal es punible el comportamiento del mulero o phisher-mule. Se presentará la solución a partir del análisis de los hechos probados de la sentencia del Tribunal Supremo 834/2012 de 25 de octubre. La tesis que se somete a prueba afirma que, el comporta-miento del mulero o phisher mule es punible como delito de receptación y no como delito de blanqueo de capitales doloso o imprudente ni como delito de estafa informática. Entre las razones que tenemos para sostener lo anterior, están las siguientes: a) el delito previo, la estafa informática, es un delito contra el patrimonio; b) el mulero no es ni autor ni cómplice del delito previo; y, c) de manera fundamental, por ser la pena de este tipo penal más proporcionada que la del blanqueo, a la menor gravedad del comportamiento del mulero en comparación con el autor de la estafa, se debe preferir su aplicación

  The paper presents a proposal for a solution to a problem that arises not infrequently in the jurisprudence: to determine under what penal type the behavior of the mulero or phisher-mule is punisha-ble. The solution will be presented based on the analysis of the proven facts of the Supreme Court sentence 834/2012 of October 25. The thesis that is put to the test affirms that, the behavior of the mulero or phisher mule is punishable as reception and not as imprudent or intentional money laundering or as a computer scam.Among the reasons we have to support the above, are the following: a) the prior crime, the computer scam, is a crime against the patrimony (property); b) the mulero is neither an author nor an accomplice of the previous crime; and, c) in a fundamental way, since the penalty of this type of crime is more proportionate than that of money laundering, to the lesser degree of behavior of the mulero compared to the author of the scam, its application must be preferred
