Resumen de Covid-19 e liberdade religiosa em Portugal

  O presente artigo, depois de sintetizar o lugar da liberdade religiosa no quadro constitucional português, descreve de modo sistematizado as principais medidas jurídicas adoptadas no Estado português com vista à prevenção e combate da pandemia COVID-19 nas suas diferentes fases, dando especial atenção à sua legitimação formal e ao seu impacto material sobre o exercício da liberdade religiosa, nomeadamente na sua vertente colectiva. Quer as referidas medidas, quer a sua legitimação formal, são em seguida objeto de reflexão e ponderação críticas, nomeadamente da referida conformidade com o quadro constitucional português. Finalmente, valora-se o quadro normativo presentemente vigente, apontando-se linhas de desenvolvimento do direito português tendentes a colocar termo a um período de grave excepcionalidade normativa.

  In this article, we begin by framing the way in which freedom of religion is inserted in the Portuguese Constitutional Law. Afterwards, we describe the legal measures adopted in Portugal in view to preventing and combatting the COVID-19 pandemic, according to the different phases of response. Special attention is given to the formal grounds of these measures, and their substantial impact in the exercise of freedom of religion, specifically, freedom of worship. The measures are the object of critical analysis against the backdrop of the Constitutional provisions that they are bound to. Lastly, we consider the current situation and look to possible developments, in the Portuguese legal system, which might contribute to better solutions to the current problems of normative exception.
