    La aplicación del principio de agotamiento del derecho de distribución en relación con los bienes sin soporte material nunca ha sido del todo pacífica. Con la Sentencia del asunto Oracle c. Usedsoft el Tribunal de Justicia estableció las bases para interpretar esta figura. Ahora, con la Sentencia del asunto Tom Kabinet, el Tribunal de Justicia añade nuevos requisitos que deben cumplirse para que sea posible la aplicación del mencionado principio con respecto a bienes sin soporte material. Sin embargo, aun a día de hoy, es complicado saber cuándo el principio de agotamiento del derecho de distribución es aplicable o no para con un determinado bien sin soporte material.

    Applying the principle of exhaustion of the distribution right in relation with goods not incorporated in material mediums has never been entirely peaceful. With the Judgment of the Oracle vs. Usedsoft case, the Court of Justice established the basis to interpret this rule. Now, with the Judgement of the Tom Kabinet case, the Court of Justice adds new requirements that must be fulfilled in order to apply of the aforementioned principle regarding goods not incorporated in material mediums. However, even nowadays, it is difficult to know when the principle of exhaustion of the distribution right is applicable or not in relation with a certain good not incorporated in a material medium.
