Es doctrina reciente de la Dirección General de los Registros y del Notariado que las cláusulas de intereses de demora de los préstamos hipotecarios para la adquisición de un bien inmueble de uso residencial, que fijen un tipo de interés moratorio superior o inferior al establecido en la Ley 5/2019, no podrán tener acceso al Registro de la Propiedad por contravenir el tenor literal del artículo 25, que establece un tipo fijo de carácter imperativo que no admite pacto a contrario. En este trabajo exponemos las razones que nos llevan a pensar que el carácter imperativo que inspira la regulación de esta Ley no impide la inscripción de un préstamo hipotecario que fije un tipo de interés moratorio inferior al legalmente establecido.
Is a recent doctrine of the General Direction of Registries and Notaries that the default interest clauses of mortgage loan for the acquisition of a property for residential use, that fix an interest type higher or lower than that established in the Law 5/2019, may not have access to the Property Registry for contravening the literal tenor of article 25, which establishes a fixed interest that does not admit a contrary agreement. In this work we present the reasons that lead us to think that the imperative nature that inspires the regulation of this Law does not prevent the registration of a mortgage loan that fix a default interest type lower than the legally established.
