Resumen de Segundo Informe de la REDUE sobre el juez español como juez del Derecho de la Unión Europea

  La Red de Especialistas en Derecho de la Unión Europea (REDUE), creada por el Consejo General del Poder Judicial en 2006, publica, un nuevo Informe sobre la función del juez español como juez del Derecho de la Unión Europea. Este Segundo informe es una continuación del Primero de 2013 y ha sido elaborado por tres magistrados. El informe se basa en una Encuesta elaborada por la Red en 2019 que fue remitida a todos los jueces españoles. La Encuesta pretende conocer la experiencia y la actitud de los jueces respecto del Derecho europeo, el uso de la cuestión prejudicial con el Tribunal de Justicia o de los instrumentos de cooperación judicial europea, así como la percepción de los principios de primacía, efecto directo y responsabilidad por la violación del Derecho de la Unión.

  The Spanish Judicial Network on EU Law (REDUE), established by the Council for the Judiciary in 2006, has just adopted a new report on the role of the Spanish judges in the enforcement of the EU Law. This Second Report, in a similar way as the First Report of 2013, has been written by three judges belonging to REDUE. It is based on the Survey prepared by the Network in 2019. This survey aimed to find out the experience and the attitude of Spanish judges regarding the European Law, the requests for a preliminary ruling, the instruments of judicial cooperation in Europe, and the understanding of principles of primacy, direct effect and liability for infringing a rule of the EU Law.
