La Compilación de Derecho Civil de las Islas Baleares (CDCB) regula el régimen económico matrimonial en sus arts. 3 y 4 (Mallorca y Menorca), y 66 y 67 (Ibiza y Formentera), creando dos peculiares sistemas de separación de bienes. Si uno de los cónyuges es empresario, dichas normas se aplicarán en lo que no contradigan a las normas mercantiles (arts. 6 a 12 del Código de Comercio (CCo) y, en su caso, arts. 77 y 78 de la Ley Concursal (LC)) y, como supletorias de estas normas. Ello tiene repercusiones en el régimen de atribución de la titularidad de los bienes individuales y comunes, en el régimen de consentimientos para disponer o administrarlos, y en las presunciones de gratuidad de las transmisiones en caso de que el empresario casado concurse.

The Compilation of Civil Law of the Balearic Islands (CDCB) regulates the matrimonial property regime in its arts. 3 and 4 (Majorca and Minorca), and 66 and 67 (Ibiza and Formentera), creating two peculiar separate property systems. If one of the spouses is a businessman, these rules will be applied if they do not contradict the commercial rules (arts. 6 to 12 of the Commercial Code (CCo) and, where appropriate, arts. 77 and 78 of the Bankruptcy Law (LC)) and, as supplements to these. This has consequences in the system of attribution of the ownership of individual and common property, in the regime of consents to dispose or administer assets, and in the presumptions of gratuitousness of the transmissions in married business spouse’s bankruptcy.
