Resumen de La responsabilidad contractual del cargador en el transporte marítimo de mercancías peligrosas

La cantidad de mercancías peligrosas que se transportan por mar se incrementa de forma constante. Este artículo examina la responsabilidad del cargador frente al porteador por el transporte marítimo de mercancías peligrosas con arreglo a los convenios internacionales (Reglas de La Haya-Visby, Reglas de Hamburgo y Reglas de Rotterdam) y la Ley de Navegación Marítima española de 2014. Aunque estas regulaciones difieren en algunos detalles, todas contienen tres grupos de normas. En primer lugar, se prevé la obligación del cargador de informar al porteador sobre la naturaleza de las mercancías, con el fin de que adopte las precauciones necesarias para un transporte seguro. En segundo término, se impone al cargador una responsabilidad objetiva por las consecuencias que produzca el incumplimiento de la mencionada obligación. Por último, se confiere al porteador el derecho a desembarcar o incluso destruir las mercancías peligrosas sin indemnización alguna, bajo ciertas circunstancias.

An ever-increasing number of dangerous goods are carried by sea. This paper deals with the shipper´s liability to the carrier for dangerous cargoes under the international conventions (Hague-Visby Rules, Hamburg Rules and Rotterdam Rules) and the Spanish Maritime Navigation Act 2014. Although these regulations differ in some details, they all contain three groups of provisions. Firstly, there is the shipper´s duty to make the carrier aware of the nature of the goods, so that he can take the precautions necessary for the safe carriage of the cargo. Secondly, the shipper will be held strictly liable for the consequences of his failure to give that information. Thirdly, the carrier is granted the right to unload or even destroy the cargo without compensation, under certain circumstances.
