    En este trabajo se abordará lo que hemos llamado el «Factor de pertinencia» en la apreciación de oficio de la nulidad de las cláusulas abusivas. Y ello se hará examinando las últimas sentencias dictadas por el Tribunal Supremo y el Tribunal de Justicia de la Unión Europea, que determinan cuándo procede el deber del juez de apreciar de oficio las cláusulas abusivas. Asimismo se examinará qué cuestiones pueden plantearse al hilo de esta postura jurisprudencial y cómo sería adecuado resolverlas

    In this paper we will examine what we have called the «Relevance Factor» in the ex officio application of the nullity of unfair terms. And this will be done by examining the latest judgments handed down by the Supreme Court and the Court of Justice of the European Union, which will determine when it is applicable the duty of the judge to examine of its own motion the unfair terms. In the same way, we will analyze what problems may arise in the light of this jurisprudential position and how it should be appropriate to solve them
