Las recientes reformas en materia de derechos humanos y de Juicio de Amparo representan nuevos retos para la situación actual de México. Estas reformas introducen cambios que modifican, de manera revolucionaria, el papel que juegan los derechos fundamentales en México; Entre estos cambios encontramos la introducción del “control de convencionalidad”. A partir de este nuevo paradigma, los jueces están llamados a ser no sólo los aplicadores e intérpretes del Derecho, sino auténticos garantes de los derechos fundamentales. En ese sentido, el nuevo paradigma requiere no ya sólo a técnicos y peritos jurídicos, sino a verdaderos teóricos del derecho. Podemos decir que este cambio radical de paradigma, en materia de derechos humanos, representa una verdadera “Revolución copernicana”.
The new constitutional reforms on Human Rights and the Amparo, represent new challenges for the actual situation in Mexico. These reforms introduce changes that modify, in a revolutionary way, the rol that play the fundamental rights in Mexico; among these changes we found the introduction of the “treaty control”. From this new paradigm, the judges are called to be, not only, the applicators and interpreters of the Law, rather they must become true defenders of the fundamental rights. In the same perspective, the new paradigm requires not only technicians and experts in Law; instead it requires real theorists of the Law. We can say that this radical paradigm, in human rights, represents an authentic “Copernican Revolution”.
