Resumen de Crítica a las ideas fundantes del actual modelo normativo de negociación colectiva en Chile y a su reforma

El presente estudio tiene por fin dar cuenta de las bases teóricas y conceptuales que subyacen al actual sistema de relaciones laborales colectivas derivado del Plan Laboral, en particular, en materia de negociación colectiva. En un momento en el que se acaba de aprobar una reforma legislativa a esta normativa, tal vez, la de mayores pretensiones desde el retorno a la democracia en el país, el ensayo pone de manifiesto como las bases fundantes del Plan Laboral mantienen su vigencia y como la reforma preserva la esencia de un modelo que conduce a claras y abiertas limitaciones a la libertad sindical. Por tanto, este trabajo pretende evidenciar que las actuales y futuras regulaciones normativas no son concordantes con el respeto debido a la libertad sindical como derecho fundamental y proponer orientaciones que contribuyan a fortalecer el reconocimiento de este derecho.

The aim of this study is to account for the theoretical and conceptual basis underlying the present system of collective labour relationships arising from the Labour Plan, especially, regarding collective bargaining matters. At the time when a legislative reform of this regulation has just been approved, which may be the most ambitious effort since the return of democracy to the country, this essay evidences the way in which the bases of the Labour Plan are still valid and the way in which the reform preserves the essence of a model leading to clear and open limitations to union freedom. Therefore, this work attempts to confirm that the present and future regulations are not consistent with the respect owed to the union freedom as a fundamental right and also proposes guidelines to strengthen the recognition of this right.
