The history of the formula «lex instituitur cum promulgatur» is briefly recalled. Con tained in Gratian s Decree (about 1140), it saw the beginnings of the development of the concept of the promulgation of ecclesial laws - with contrasting interpretations - in the classical era of canon law. The way in which pontifical laws were promulgated in the 13th century, with public reading and posting at the doors of the basilicas, also attested to the fact that the texts obtained the force of law by means of "publication". However, there has been no lack of specific attention throughout the history of the Church to the recipients, especially when delicate questions such as the validity of marriage were involved.

Viene richiamata in breve la storia della formula «lex instituitur cum promulgatur». Contenuta nel Decreto di Graziano (1140 circa), essa ha avviato un processo di maturazione del concetto di promulgazione delle leggi ecclesiali nell'epoca classica del diritto canonico con interpretazioni contrastanti. Anche le modalità di promulgazione delle leggi pontificie che si impongono dal XIII secolo con la lettura pubblica e affissione alle porte delle basiliche attestano che i testi ottengono forza di legge per mezzo della "pubblicazione". Tuttavia non sono mancate specifiche attenzioni lungo la storia della Chiesa ai destiriatari, specialmente quando erano implicate questioni delicate come la validita del matrimonio.
