Resumen de Autonomía local y tutela. Un equilibrio inestable

La autonomía local es compatible con potestades de control otorgadas por las leyes a las Administraciones estatal y autonómicas. Pero ello, dentro de ciertos límites que se derivan de la misma consagración de la autonomía. Se exponen las líneas maestras de esos límites y cómo han ido evolucionando en los últimos años hasta llegar a la situación actual que parece a la búsqueda de un nuevo equilibrio. En concreto, se estudia la solución que a este respecto ofreció la Ley Reguladora de las Bases del Régimen Local. Con ese marco, se analizan los rasgos esenciales de las principales técnicas que canalizan ese control y los problemas que plantean. En especial, la anulación y suspensión de los actos locales; la subrogación; y las autorizaciones y aprobaciones. También otras fórmulas alternativas y complementarias. Finalmente, se ensaya una reconstrucción general de la tutela sobre la base de la Carta Europea de la Autonomía Local

Local autonomy is compatible with the existence upon it of control powers of the State and the regional administrations conferred by the law. But only within certain limits derived from the legal recognition of the local autonomy itself. This paper exposes those limits and how they have evolved in recent years seeking a new balance. Specifically, it analyses the standpoint provided by the Law establishing the Basic Regulation of Local Government. Within this framework, it examines the main control techniques and the problems that they pose, focusing on the annulment and suspension of the local administrative acts, the subrogation and the authorizations and approvals. Along with those main control techniques, others alternatives and complementary techniques are analyzed as well. Finally, a general rebuilding of the concept of tutelage is proposed on the basis of European Charter of Local Self-Government
