    En el presente trabajo se realiza un análisis de la compatibilidad del despido objetivo por faltas de asistencia del trabajador previsto en el artículo 52 d) del Estatuto de los Trabajadores con la normativa internacional y, en particular, con la Directiva 2000/78/CE del Consejo, de 27 de noviembre de 2000 (relativa al establecimiento de un marco general para la igualdad de trato en el empleo y la ocupación), al hilo de la sentencia del Tribunal de Justicia de la Unión Europea de de enero de 2018 (Caso Ruiz Conejero) y de la reciente sentencia del Tribunal Superior de Justicia de Castilla-La Mancha de 10 de abril de 2019.

    In the present work we carry out an analysis of the compatibility of the objective dismissal for lack of assistance of the worker foreseen in the article 52 d) of the Workers' Statute with the international norm and, in particular, with the Council Directive 2000/78/EC of 27 November 2000 (establishing a general framework for equal treatment in employment and occupation), following the judgment of the Court of Justice of the European Union of 18 January 2018 (Case Ruiz Conejero) and the recent ruling of the High Court of Justice of Castilla-La Mancha of 10 April 2019.
