  El artículo 18 ter del Reglamento de la FIFA sobre el Estatuto y la Transferencia de Jugadores prohíbe la participación de terceros-inversores en el traspaso de futbolistas profesionales. En el presente artículo se examina el propósito de la prohibición. La estructura se divide en cuatro partes. En la primera se aborda la relación entre la FIFA y los terceros inversores. En la segunda se desarrolla el fundamento de la distinción entre los derechos federativos y los derechos económicos federativos de los futbolistas. En la tercera se analiza la finalidad de la prohibición de terceros-inversores (pros y contras). Y, finalmente, se recoge una propuesta de reforma.

  Third-party ownership refers to those agreements whereby a third party provides a club (or a player) with money in return for a percentage of a specific player’s future transfer fee. This paper addresses the rationale for banning this funding mechanism in article 18 ter FIFA Regulations on the Status of the Transfer of Players. The structure is divided into four parts. Firstly, the relationship between FIFA and third-parties configures the legal framework. Secondly, the explanation of third-parties’ ownership of economic rights introduces the problem. Thirdly, the pros and cons of the ban give arguments in favor of new regulation. Finally, current rules will lead to a proposal for reform.
