Resumen de Responsabilidad empresarial en materia de derechos humanos en el derecho internacional
Sobre la base de la estrecha relación existente entre la Economía de la Cooperación y el discurso de los Derechos Humanos, este artículo repasa la historia y los últimos desarrollos habidos en el Derecho Internacional en materia de Empresas y Derechos Humanos. Desde unos años en que la cuestión se regía por principios y recomendaciones relacionados con el ámbito de la Responsabilidad Social Corporativa y que debía calificarse en todo caso de soft law, a día de hoy avanzamos hacia un endurecimiento del sistema que se dirigiría a una futura Responsabilidad Corporativa en materia de Derechos Humanos (RCDH) por varias vías complementarias y simultáneas que el autor repasa: a) el desarrollo de los Principios Ruggie por la ONU; b) la búsqueda de un polémico nuevo tratado internacional; c) el quehacer de los órganos de tratados de la ONU sobre la materia; d) los planes nacionales de derechos humanos; y e) el juego de las múltiples jurisdicciones.Resumen alternativo:Building on the close relationship between Cooperation Economy and the Human Rights discourse, this paper reviews the background and latest developments in International Business and Human Rights Law. This issue has been governed by the principles and recommendations related to the CSR field for the past few years, and it should be in any case termed soft law today. However, we move towards a tightening of the system that may lead to a future Corporate Responsibility for Human Rights (CRHR). This involves several complementary and simultaneous approaches that are reviewed by the author: a) the development of the UN's Ruggie Principles; b) the search for a controversial new international treaty; c) the work of the UN treaty bodies on the subject; d) national action plans on human rights; and e) the game of multiple jurisdictions.
