Resumen de Hinojosa y su discurso académico sobre la condición jurídica de la mujer casada

Cuando se cumple el primer centenario de la muerte de Eduardo de Hinojosa y Naveros, en este artículo pretendemos analizar el discurso que pronunció en el año 1907 al ingresar en la Real Academia de Ciencias Morales y Políticas. Dicho discurso versa sobre la capacidad jurídica de la mujer casada, en él realiza un estudio del devenir del estatus jurídico de la esposa dentro de la sociedad conyugal, desde la época prerromana hasta los albores del siglo XX. Especialmente dedica su atención al Derecho de Castilla, pero también se ocupa de los Derechos territoriales de España y de los ordenamientos jurídicos extranjeros. Todo este análisis le hace alcanzar ciertas conclusiones y criticar al Código Civil vigente, reclamando una reforma del mismo para mejorar las condiciones jurídicas de la mujer casada. Censura que el legislador no se inspirara en nuestra tradición, sino en el Código Civil francés.
Por otra parte, analizamos la contestación al discurso de Hinojosa a cargo de Luis Pidal y Mon, que se singulariza por un pensamiento más conservador y reprueba la reforma del Código Civil.

When the principle of the death of Eduardo de Hinojosa and Naveros is fulfilled, this article intends to analyze the discourse that he delivered in 1907 upon entering the Royal Academy of Moral and Political Sciences. This study deals with the legal capacity of married women, where they study the evolution of the legal status of the wife within the conjugal society, from pre-Roman times to the dawn of the 20th century. Especially, it devotes its attention to the Law of Castile, but also deals with the territorial rights of Spain and foreign legal systems. All this analysis makes him reach certain conclusions and criticize the current Civil Code, calls for a reform and improvement in the legal conditions of married women. Criticizes that the legislator was not inspired by our tradition, but in the French Civil Code.
On the other hand, we analyze the response to the speech of Hinojosa by Luis Pidal y Mon, who is singled out by a more conservative thought and does not consider timely the reform of the Civil Code.
