    En este trabajo, el autor investiga la disposición testamentaria de asignación de un bien determinado, verificando cuando esta atribuye al beneficiario la calidad de heredero. Luego se ocupa de identificar el destino del caudal hereditario, cuando los bienes existentes en el momento de otorgamiento del testamento son mayores o minores de los existentes en el momento de la apertura de la sucesión. Investiga, por lo tanto, las relaciones entre la institución de heredero ex re certa y la partición de la herencia hecha por el testador.

    In this paper, the author investigates the testamentary disposition «ex re certa», verifying when it attributes to the beneficiary the status of heir. The Author then investigates the fate of the inheritance, when the assets existing at the time of the packaging of the will are larger or smaller than those existing at the time of the opening of the succession. Investigates, therefore, the relationship between the institution of heir «ex re certa» and the division of inheritance made by the testator.
