En este trabajo se evidencian las tensiones jurídicas e interpretativas que ha generado la recepción de la jurisprudencia interamericana y el control de convencionalidad entre los criterios de la SCJN, así como los desafíos que implica para los operadores jurídicos en los próximos años. A pesar de que la jurisprudencia de la SCJN ha privilegiado las restricciones constitucionales sobre las normas convencionales, lo cierto es que allí en donde no hay una restricción expresa, el operador judicial debe resolver los asuntos de su conocimiento haciendo realidad el control de convencionalidad a la luz del principio pro persona; por otro lado, en el terreno de las restricciones constitucionales expresas, la Segunda Sala de la SCJN, en sintonía con la perspectiva garantista de la Primera Sala, ha establecido que el operador jurídico debe interpretarlas de la manera más favorable a las personas.

In this project there are analyzed the legal and interpretative tensions generated by the reception of Inter-American binding legal precedents and conventionality control among the criterion of the Supreme Court of Justice of the Nation (SCJN, for its initials in Spanish) as well as the challenges implied for the legislators in the future years. Despite the fact that the biding legal precedents of the SCJN has privileged the constitutional restrictions to the conventional rules, the fact is that where a restriction is not stated, the legislator must solve affairs over which they preside by applying conventionality control in the light of the pro-person principle; on the other hand, regarding the constitutional restriction stated, the Second Division of la SCJN, in accordance with the constitutional perspective of the First Division, has established that the legislator must interpret them in the most favorable manner for the persons.
