Resumen de La doble filiación materna: de la imposibilidad a la presunción de maternidad

  Las deficiencias técnicas del artículo 7.3 de la Ley 14/2006, sobre técnicas de reproducción humana asistida, que faculta a la esposa de la madre gestante a consentir que se atribuya a su favor la filiación del hijo de su cónyuge, han provocado que su aplicación haya suscitado abundantes con­flictos, que se han venido reflejando en el ámbito de nuestros tribunales. Con este estudio se pretende exponer la evolución legislativa y jurisprudencial de la norma, repasando las resoluciones habidas en la materia, a los fines de actualizar resumidamente el estado de la cuestión y proponer las reformas legales que creemos necesarias para solventar más adecuadamente los problemas suscitados, de acuerdo con el principio de igualdad y no discriminación.

  The technical deficiencies of article 7.3 of Law 14/2006, on techniques of assisted human reproduction, which entitles the wife of the pregnant mother to consent that the filiation of her spouse's son is attributed to her, have aroused many conflicts in the scope of our courts. The aim of this paper is to expose the legislative and case law evolution of this rule, reviewing the resolutions in the issue, in order to update briefly the state of the matter and propose the legal reforms that we believe necessary to solve the problems more adequately, in accordance with the principle of equality and non-discrimination.
