La réplica intenta contestar las dos críticas formuladas por el profesor Hernández en su generosa recensión al libro mencionado. La primera cuestión concierne a la punibilidad del particular que “falta a la verdad en la narración de hechos sustanciales” (Art. 193 N. 4 del Código Penal) en un documento público, donde la respuesta procura mostrar que dicha tesis se sustenta en algunas razones más que la sola remisión contenida en el Art. 194 CP a todas las clases de falsedad descritas en el artículo precedente. El segundo punto de discusión atañe nuevamente al alcance de la exigencia de “perjuicio de tercero” en el marco de la falsificación de documentos privados, donde la respuesta comparte con la crítica que dicha exigencia no tiene un valor puramente “declarativo”, sino que constitutivo de dicha clase de falsedad documentaria.

The reply tries to answer the two criticisms made by Professor Hernández in his generous review of the aforementioned book. The first question concerns the punishability of the individual who “gives false statement about material facts” (Article 193 No. 4 of the Criminal Code) in a public instrument, where the response seeks to show that the thesis is based on reasons, more than the remission of Art. 194 CP to all the types of falsification described in the preceding article. The second point of discussion, concerns again the scope of the requirement of “third party prejudice” in the context of the falsification of private instruments, where the response shares with the criticism that said requirement does not have a purely “declarative” force, but rather, for this kind of falsification, a constitutive force.
