Resumen de Un acercamiento crítico a los problemas antropológicos, políticos y filosóficos del pluralismo jurídico

  Intentaremos abordar de forma crítica esos procesos de construcción de un nuevo marco jurídico, puestos en marcha en algunos países de la América andina durante los últimos lustros, caracterizados por el reconocimiento del carácter plurinacional, multiétnico e intercultural de las Repúblicas, enmarcadas hasta entonces en los parámetros homogeneizadores del estado criollo y mestizo. Tales procesos, a su vez, han conducido al reconocimiento de los derechos de los pueblos indígenas originarios y, de forma subsecuente, al establecimiento de un derecho indígena poseedor de una jurisdicción especial. Pero este nuevo horizonte, si bien representa un proyecto eminentemente decolonial en muchos aspectos, no está exento de contradicciones, fricciones y limitaciones. un escenario de radical pluralidad jurídica quebrantaría la posibilidad de establecer un marco común de ciudadanía. son muchas, por lo tanto, las dimensiones antropológicas, políticas, jurídicas y filosóficas que deben ser analizadas y discutidas para arrojar algo de luz en esta importante cuestión.

  We will try to critically examine the processes of constructing a new legal framework which were begun in some Andean states during recent decades and which are characterised by the recognition of the multinational, multiethnic and intercultural character of the Republics, framed hitherto within the homogenising parameters of the creole and mestizo state. These processes have in turn led to the recognition of the rights of the original indigenous peoples and, subsequently, to the establishment of indigenous law with a special jurisdiction. However, this new horizon, despite the fact that it represents a project which is eminently decolonial in many respects, is not without contradictions, frictions or limitations. A scenario of radical legal plurality would lessen the possibility of establishing a common citizenship framework. There are therefore many anthropological, political, legal and philosophical aspects which should be analysed and discussed so as to shed some light on this important issue.
