El Tribunal Constitucional ha suprimido las tasas judiciales en el orden contencioso-administrativo porque su elevada cuantía a su juicio supone una quiebra del derecho a la tutela judicial efectiva. A nuestro modo de ver este fundamento no es acertado porque de acuerdo con las tasas sólo deberían considerarse inconstitucionales cuando impidieran el acceso a la jurisdicción por insuficiencia económica para su pago, conforme a las circunstancias concurrentes. A nuestro juicio el fundamento debería haber sido la naturaleza de orden público del control jurisdiccional de la Administración junto a la quiebra del derecho a la tutela judicial efectiva que suponen por su carácter disuasorio.
The Constitutional Court has abolished the court fees in the administrative justice given that its high amount is considered a violation of the right to an effective judicial (legal) protection. From our point of view, this legal grounds are wrongs because the court fees should only be considered unconstitutional when they impede access to the judicial system on economic grounds, that is to say an inability to meet the legal costs as they apply in each individual situation. In our opinion, any grounds for abolishing court fees should be based on the public interest for the judicial control of the Administrative legal system along with the non-withdrawal of the right to effective judicial protection, due to the deterrent character of the court fees.
