    The problem of natural right is a philosophical and not a historical problem. But today, in order to think of a philosophical discussion of natural right, we have to engage in historical studies. The present-day criticism of natural right is merely a repetition of the age-old criticism of natural right, according to which all notions of justice or morality are conventional. Modern natural right is presented as being completely independent of positive right; it is related to the idea of a state of nature; it tends to be a doctrine of rights rather than of duties; it is a doctrine of freedom. Modern natural right, whose originator is Thomas Hobbes, must be considered in the context of the attempt at establishing a new science of politics, directed against the utopianism of classical political science, and oriented towards a desirable order whose actualization would be a matter of necessity.

    Le problème du droit naturel est un problème philosophique et non un problème historique. Mais aujourd’hui, afin de réfléchir à une discussion philosophique du droit naturel, nous devons nous engager dans des études historiques. La critique contemporaine du droit naturel est simplement une répétition de la vieille critique du droit naturel, selon laquelle toutes les notions de justice ou de moralité sont conventionnelles. Le droit naturel moderne est présenté en complète indépendance par rapport au droit positif ; il est lié à l’idée d’un état de nature ; il tend à être une doctrine des droits plutôt qu’une doctrine des devoirs ; c’est une doctrine de la liberté. Le droit naturel moderne, à l’origine duquel se trouve Thomas Hobbes, doit être considéré dans le contexte de la tentative d’établir une nouvelle science de la politique, dirigée contre l’utopisme de la science politique classique, et orientée vers un ordre désirable dont l’actualisation serait nécessaire.
