El margen de apreciación nacional y sus límites en el Sistema Interamericano de derechos humanos

    Dentro del Sistema Interamericano de derechos humanos, se ha generalizado el Control de Convencionalidad como un mecanismo necesario y obligatorio para todos los Estados firmantes de la Convención Americana de Derechos Humanos. Este control implica no solo la interpretación de los derechos fundamentales a partir de la Convención e interpretación que la Corte Interamericana realice, sino también la utilización de su jurisprudencia como base interpretativa para todos los Estados. Dentro de este esquema, el margen nacional de apreciación, cumple un papel importante, tomando en cuenta las necesidades y particularidades propias de los diferentes países firmantes, para poder interpretar y llevar a cabo las obligaciones adquiridas con el Sistema, sin caer en responsabilidad internacional por incumplimiento. No obstante, dentro de la práctica de este mecanismo es necesario imponerle ciertos límites y a la vez entender que, a partir de él también se generan limitaciones para el ámbito internacional.

    Within the inter-American system of human rights, conventionality control has been generalized as a necessary and mandatory mechanism for all signing Member States to the American Convention of Human Rights. This type of control includes, not only the interpretation of the human rights contained in the Convention and the elucidation provided by the Inter-American Court, but also its jurisprudence, which serves as an interpretative basis for all States. According to this scheme, the national appreciation margin, plays a very important role, in respect to the necessities and particular characteristics of all signing Members, to interpret and fulfill those obligations acquired with the system, without breaching international obligations and responsibilities. However, within the practice of this mechanism, it is important to determine clear application limits and understand that it also entails certain international limitations.
