Resumen de Interlocuções teóricas sobre a violação e a proteção dos direitos humanos da mulher ao longo dos tempos na legislação nacional e internacional

  In that article devoted to analysis of gender violence over the years in national and international law, which was obtained care to surround the subject with the theoretical framework by proposing a dialogue with the structuralist thinkers like Deleuze, Michel Foucault and Pierre Bourdieu concomitant Simone Beauvoir, Judith Butler under the power of the theory of approach that prevails in human, social and legal relations. There was a concern to rethink the concept of gender, from the deconstruction of its structural elements linked to biological, social and historical condition. In addition to this deconstruction, other concepts were worked out, such as: sex, sexuality and identity. In this initial trajectory it was emphasized that men and women are plural and complex citizens, and in the midst of this is violence that is also the result of conflicts that require this lacking space for dialogue and understanding. Finally, as a text-building mechanism used the hypothetical-deductive method, based on literature.

  No referido artigo dedicou-se a análise da violência de gênero ao longo dos tempos na legislação nacional e internacional, onde se obteve o cuidado para circundar o tema com o marco teórico propondo um diálogo com os pensadores como Deleuze, Michel Foucault, Pierre Bourdieu e Judith Butler sob o enfoque da teoria do poder que impera nas relações humanas, sociais e jurídicas. Houve a preocupação em repensar o conceito de gênero, a partir da desconstrução dos seus elementos estruturais ligados a condição biológica, social e histórica. Além dessa desconstrução, outros conceitos foram trabalhados, como: sexo, sexualidade e identidade.  Nessa trajetória inicial enfatizou-se que os homens e as mulheres são cidadãos plurais e complexos, e em meio a isto está a violência que também é fruto dos conflitos que demandam desse espaço, carente de diálogo e compreensão. E por fim, como mecanismo de construção do texto utilizou-se o método hipotético-dedutivo, baseado em pesquisa bibliográfica.
