El fragmentado contexto político vivido tras las elecciones generales en 2015 y 2016 ha evidenciado algunas cuestiones abiertas en el diseño constitucional del procedimiento de investidura. Así, este trabajo tiene por objeto analizar las carencias y las fortalezas mostradas por el artículo 99 de la Constitución a la luz de los avatares políticos de la XI y la XII Legislatura y estudiar la oportunidad de una reforma constitucional.

The fragmented political context after the general elections in 2015-2016 has revealed some open questions in the constitutional design of the procedure of formation of the Government. Thus, this paper aims to analyze the shortcomings and strengths shown by Article 99 of the Constitution taking into account the political vicissitudes of the XI and XII Legislature. And it is also proposed to study the opportunity for constitutional reform.
