Resumen de Ocupación carcelaria: Hipótesis acerca del descenso de la población penitenciaria en España

El objeto del presente trabajo es identificar las causas o motivos que explican la disminución de la población penitenciaria en España, en aras de verificar si estamos ante una nueva tendencia del sistema penitenciario español que puede mantenerse en el tiempo. Con la anterior pretensión, presentamos tres hipótesis que pueden explicar la curva descendente de la población penitenciaria. Tras el análisis de las mismas, llegamos a la conclusión de que la reducción de la ocupación carcelaria se debe fundamentalmente a la disminución de la población extranjera que reside en el país y a la reforma penal operada por la LO 5/2010, de 22 de junio, en materia de tráfico de drogas. En cambio, la utilización de herramientas alternativas o sustitutivas a la pena de prisión no ha resultado trascendente para la nueva realidad de las cárceles españolas.

The subject of this essay is identify the causes that explain the decrease in the number of inmates in Spain. We want to verify if we’re facing a new trend in the Spanish penitentiary system that can prevail. There are three hypothesis to explain the decreasing curve in the inmate population. After analyzing them, we arrive to the conclusion that the decrease of the inmate population is caused by the decrease of immigrants in the country and the modification in the LO 5/2010 issued on June 22nd in regards of drug trafficking. In the other hand, the use of alternative punishments and parole hasn’t affect the new reality of Spanish prisons.
