El artículo 9 del Convenio Multilateral Iberoamericano de Seguridad Social aborda el tema de la legislación aplicable en concreto, la regla general. Así se establece que las personas a quienes sea aplicable este Convenio estarán sujetas exclusivamente a la legislación de Seguridad Social del Estado en cuyo territorio ejerzan una actividad. Se opta, por la lex loci laboris como regla general a la hora de establecer cuál es legislación aplicable a los trabajadores sujetos al ámbito del Convenio Multilateral Iberoamericano de Seguridad Social cualquiera que sea su nacionalidad o lugar de residencia y que parte de la regla de la unicidad de la legislación aplicable. Se trata de una regla típica de coordinación de los Sistemas de Seguridad Social que además de favorecer la seguridad jurídica pretende resolver las posibles dudas en torno a la legislación aplicable y que está presente en otros convenios o acuerdos bilaterales o multilaterales en materia de Seguridad Social.

Article 9 of the Multilateral Ibero-American Social Security Agreement addresses the issue of the law applicable in particular, the general rule. Thus it is established that the persons to whom this Agreement applies shall be subject exclusively to the social security legislation of the State in whose territory engaged in an activity. This text opts for the lex loci laboris as a general rule to establish which is the legislation applicable to workers covered by the scope of the Multilateral Ibero-American Social Security Agreement regardless of their nationality or place of residence and is a manifestation of the principle of a single national law applicable. This is a typical rule of coordination of Social Security Systems that would enhance the legal certainty intended to resolve any doubts about the applicable law and is present in other agreements or bilateral or multilateral agreements on social security.
