Resumen de Le droit international privé russe revisité

  • This contribution gives a short survey of the latest developments in the Russian private international law. Despite of the present political situation, it may be of some interest to see how the Russian law has been revisited from an international perspective on the basis of the federal law no. 260-FZ of September 2013 on "the introduction of changes in the 3rd part of the civil code of the Russian Federation", which entered into force on 1st of november 2013. With regard to the applicable law, these changes concern essentially property rights, the form of the juridical acts, contracts and torts. Three questions previously not addressed by the Russian private international law are now taken into account: subrogation, agency and set-off. It is worth mentioning that the articles concerning contracts and torts are largely inspired respectively by the Regulations of 17 June 2008 (Rome I) and of 11 July 2007 (Rome II) of the European Union, which indirectly enjoy a new a very large geographical extension. A French translation of the law of 30 September 2013 is annexed to the contribution.
