    La tutela del daño tradicional por contaminación se regula fundamentalmente a través de acción negatoria (art.590 C.c.), la responsabilidad civil extracontractual (1902 C.c.), la responsabilidad civil por inmisiones (art.1908.2 C.c.), y el abuso de derecho (7.2 C.c.). También se suele utilizar la tutela posesoria frente a perturbaciones ilegítimas, el art.7.2 de la Ley de Propiedad Horizontal, la Ley de Arrendamientos Urbanos, y la tutela sumaria de los derechos fundamentales —integridad física y moral (art.15 CE), intimidad personal y familiar (art.18 CE) e inviolabilidad del domicilio (art.21 CE)—. La doctrina aplica, en ocasiones, la Ley Orgánica 1/1982, de 5 de mayo, cuando las intromisiones ilegítimas afecten la intimidad personal y familiar. Finalmente, el Texto Refundido de la Ley del Suelo de 2008 permite a los potencialmente dañados solicitar la demolición de construcciones que no respeten las prescripciones y limitaciones vecinales ex art.49 TRLS08.

    The Civil protection for pollution damage is regulated fundamentally by injunction (art 590 CC), tort liability (1902 CC), tort liability of private nuisance (1908.2 CC), and prohibition of abuse of rights (7.2 CC). It is also often used the possessory protection against unlawful interference, the article 7.2 Condominium Act, the urban leases law, and the summary protection of fundamental rigths —physical and moral integrity (art.15 Spanish Constitution), personal and family privacy (art.18 EC) and right to domestic privacy (art.21 EC)—. The doctrine apply, sometimes, the Organic Law 1/1982 of 5 May, when the unlawful intromision affect the right of personal and family privacy. Finally the consolidated text of Land Act (art.49) alows apply the person potentially damaged for demolition of buildings that do not meet the requirements and limitations of neighborhood laws.
