Il modello legislativo in materia di procreazione assistita, già caratterizzato da profonde incertezze interpretative, è stato investito da plurime sentenze della Corte Costituzionale e della Corte di Strasbrugo, le quali hanno demolito i profili più restrittivi della legge n. 40 del 2004. In questo saggio viene esaminata la portada degli interventi giurisprudenziali al fine di porre le premesse per una lettura sistematica della disciplina attualmente vigente.
The rules on assisted procreation, already characterized by deep uncertainty in interpretation, was hit by multiple rulings of the Constitutional Court and of the Court of Strasbourg, which demolished the most restrictive profiles of the law no. 40/2004. This essay examines the extent of the juridical decisions in order to lay the foundations for a systematic reading of the rules currently in force.
