El presente trabajo tiene como objeto la defensa del sistema de recursos administrativos planteados ante órganos administrativos independientes, como complemento al sistema de recursos ante la jurisdicción contencioso-administrativa, y como alternativa más eficaz que las vías de la mediación, conciliación o arbitraje.
Se hace un breve examen de la realidad ya existente en nuestro país sobre este tipo de recurso, y se analiza en profundidad el modelo de estos recursos en el Reino Unido. Se examina el concepto de Administrativa Justice del Reino Unido y la regulación de los llamados Administrative Tribunals, como formas de articular en sistema de Proportionate Dispute Resolution. Por último, se exponen las notas básicas que deberían configurar un posible sistema de este tipo de recursos administrativos en nuestro país.
The aim of this work is to defend the system of administrative remedies filed before independent administrative bodies as a complement to administrative justice and judicial reviews, and as an alternative more efficient than mediation, conciliation and arbitration.
This work offers a brief presentation of the current practices in the field of administrative remedies in Spain, as well as a deep analysis of the model applicable in the United Kingdom. The concept of administrative justice and the regulation of administrative tribunals in this country are examined as a way to articulate the Proportionate Dispute Resolution system. Finally, some key aspects are presented that should be included if Spain decided to create such system of administrative remedies.
