Es evidente la existencia dentro de la experiencia jurídica romana de una progresiva evolución de la configuración de los conceptos e instituciones fiscales, con la finalidad de poder adaptarse a las profundas transformaciones que experimentaba la sociedad y la economía romana con el devenir de los tiempos, tal y como señala el Prof. Antonio Fernández de Buján. Es también innegable que las fuentes literarias han de ocupar un lugar importante en la labor del romanista, no sólo por los testimonios directos que pueden proporcionar sobre normas e instituciones jurídicas, sino fundamentalmente porque el Derecho es un fenómeno social que sólo puede ser comprendido y explicado totalmente en el marco del ambiente en que se aplica, perspectiva alcanzable básicamente a través del recurso a las citadas fuentes literarias. Este trabajo precisamente busca profundizar en estas dos ideas tomando como referencia el epistolario de Basilio de Cesarea, uno de los más influyentes personajes de la segunda mitad del siglo IV, quien evidenció una innegable preocupación no sólo por los temas espirituales, sino también por las cuestiones más terrenales que afectaban a los habitantes de su provincia.

It’s clear the existence within the Roman legal experience of a progressive evolution in shaping the concepts of the different fiscal institutions, and this in order to adapt them to the profund changes ocurring in the roman society and economy, as it has been yet pointed by Professor Antonio Fernández de Buján. It’s also undeniable that literary sources should occupy an important place in the work of a romanist, not only for their direct testimony on legal rules and institutions, but mainly because the Law is a social phenomenon that can only be understood and fully explained under the environment in which it applies, and that’s a perspecitve basically achievable only under the aforementioned literary sources. This work seeks to deepen precisely these two ideas, taking as reference the correspondence of Basil of Caesarea, one of the most influential figures of the second half of the fourth century, who showed an undeniable concern not only about spiritual matters, but also by the more mundane issues affecting the people of his province.
