A importância de fatos histórico-sociais para o reconhecimento e desenvolvimento dos Direitos Humanos e Fundamentais

    This article aims to address socio-historical facts which have significant relevance to the acknowledgement and emergence of Human Rights and Fundamental Rights. The Natural Law movement, with its construction based on Universal Rights, influenced the theorization of Human Rights; the Enlightenment Age, based on which we constructed a critical view of that state of things and its revolutionary character, by bringing up Rights as a defense against the state. The French Revolution, as an episodic outcome in which all ideas until then constructed were applied and universalized in some respects. The Declaration of Human and Civil Rights of 1789, having established in the law the above-mentioned ideas that supported the Revolution, ensured their preservation and observance. Capitalism and its intrinsic relationship with the scenario in which the Industrial Revolution broke out, which gave rise to new movements claiming for Rights, enabling the emergence of Second-Generation Human Rights responsible for creating State intervention as necessary to put into effect the Right to substantial equality. Finally, the Catholic Church, which universalized its humanitarian thinking through the encyclicals, especially Rerum Novarum and Quadragesimo Anno, reinforcing and complementing what had already been built by historical, political and social movements. Therefore, it can be concluded that Human and Fundamental Rights have definitely taken root according to the molds left by these facts in a global context and especially in those countries that are signatories of the Constitutional State.     Objetivo deste artigo é tratar de fatos histórico-sociais que possuem significativa relevância para o reconhecimento e desenvolvimento dos Direitos Humanos e dos Direitos Fundamentais. O movimento jusnaturalista com sua construção baseada em Direitos universais e eternos influiu na teorização dos Direitos Humanos. O Iluminismo, a partir do qual se construiu uma visão crítica daquele estado de coisas e seu caráter revolucionário, responsável por trazer à baila os Direitos com função de defesa em face do Estado. A Revolução Francesa como resultado episódico no qual todas as ideias até então erigidas foram em algum aspecto aplicadas e universalizadas. A Declaração dos Direitos do Homem e do Cidadão de 1789 por positivar as aludidas ideias que embasaram a Revolução, garantindo sua preservação e observância. O Capitalismo e sua intrínseca relação com o cenário no qual eclodiu a Revolução Industrial, e esta por ensejar novos movimentos reivindicatórios de Direito, viabilizando o surgimento dos Direitos Humanos de segunda geração, responsáveis por criar o intervencionismo estatal como necessário à efetivação do Direito à igualdade substancial. Por fim, a Igreja Católica, que, por meio das Encíclicas, em especial Rerum Novarum e Quadragesimo Anno, universalizou seu pensamento humanitário, reforçando e complementando o que já havia sido construído pelos movimentos históricos,políticos e sociais. Diante disso, conclui-se que os Direitos Humanos e Fundamentais arraigaram-se, nos moldes possibilitados por esses fatos, definitivamente no cenário mundial, sobretudo naqueles países signatários do Estado Constitucional.Palavras-chave: fatos histórico-sociais, Direitos Humanos, Direitos Fundamentais.
