La casi totalidad de la Doctrina y la Jurisprudencia, afirma que el bien jurídico protegido por el delito será la biodiversidad, concretamente la biodiversidad cinegética, y por tanto el mismo será un delito medioambiental, con lo que su inclusión entre estos delitos será la correcta. Aunque realmente se trataría de un delito patrimonial, que requerirá su tratamiento como delito autónomo, siendo incorrecta su actual ubicación sistemática. Se puede concluir que estamos ante un delito patrimonial autónomo, de mera actividad, cuyo objeto material incluye las especiescinegéticas, las clasificadas de interés especial, y las no cinegéticas.

The free development of personality has its foundation in the dignity of the person.
