Una Decisión de la Comisión Europea de 14 de mayo de 2004, acompañada por el Acuerdo Internacional concluido entre la Unión Europea y los Estados Unidos de América, de 28 de mayo de 2004, estableció el marco jurídico que permitía a las compañías aéreas transferir los datos PNR de los pasajeros. Tras la anulación de ambos instrumentos por parte del Tribunal de Justicia de las Comunidades Europeas, en 2006, el marco fue sustituido en un primer lugar por el Acuerdo provisional entre la Unión Europea y los Estados Unidos de América de 16 de octubre de 2006 y, después, por el Acuerdo firmado el 23 de julio de 2007 por la UE y el 26 de julio por los EE.UU.

A May 14, 2004, Decision of the European Commission and the May 28, 2004, International Agreement between the European Union and the United States of America, have created the legal frame to allow the airlines the transference of the passengers information data. After the annulment of both sources by the Court of Justice of the European Communities in 2006, the legal frame was substituted first by the October 16, 2006, Provisional Agreement between the European Union and the United States of America and, after, by the Agreement signed on July 23, 2007 by the EU and on July 26, 2007 by USA.
