  • Sommaire Cet article aborde la question non résolue du statut juridique international, et des droits y afférents, d'Omar Khadr, ressortissant canadien détenu par les États-Unis sur le champ de bataille en Mghanistari a l'áge de quinze ans, puis incarcéré a Guantanamo Bay.L'analyse se concentre principalement sur le statut potentiel de Khadr comme "combattant illégal" et comme enfant soldat.

    Reconnaissant que ces questions ont suscité de vifsdébats, l'auteur donne un aperc;:ude ces débats a travers du prisme du cas particulier de Khadr. Comme l'auteur le fait remarquer, le droit international entourant chaque aspect de la situation de Khadr est loin d' étre limpide.Toutefois, méme en admettant l' existence de controverses et d'ambigultés en ce qui a trait au statut de Khadr, l'auteur soutient que les États-Unis et le Canada ont, apparemment, cherché a exploiter ces ambiguítés pour justifier mépris de ses droits. L'article conclut que cette approche est, en soi, contraire aux principes fondamentaux du droit international humanitaire.

    Summary Thisarticle addresses the unresolved question of the international legal status, and resulting rights, of Ornar Khadr - a Canadian national detained by the United States on the battlefield in Mghanistan at the age of fifteen and subsequentIy incarcerated at GuantanamoBay.The article focuses primarily on Khadr's potential status as an "un lawful combatant" and as a child soldier.

    Acknowledgingthat there has been a great deal of scholarly debate surrounding these issues, it provides an overview of this debate through the lens ofKhadr's particular case. Asthe author observes, internationallaw surrounding each aspect of Khadr's status is far from clear. However, even accepting the existence of controversy and ambiguity surrounding Khadr's status, the author argues that the United States and Canada have, seemingly, sought to exploit thisambiguityin order tojustify disregard for his rights. The article concludesby observing that this approach is, in itself, contrary to the foundational principles of international humanitarian law.
