Para uma crítica da razão androcêntrica: gênero, homoerotismo e exclusão da ciência jurídica

    This paper studies up from the feminist epistemology, since its theoretical limit is Michel Foucault principles on universal knowledge, the search for the truth regarding human sexuality and power use as well as social control, which are part of this universe, it also regards the methodology defended by Alda Facio, the juridical phenomenon analysis. It was observed so, through the law philosophy, the reflects produced by androcentrical behavior about juridical science, that by the time has conducted, not only females segregation as subjects of rights, but also excluded the homoerotic expression from the protective environment that the modern state has proposed.

    Este artigo parte da epistemologia feminista, tomando como marco teórico à formulação de Michel Foucault sobre os saberes, a busca da verdade em torno da sexualidade humana e o exercício de poder e controle sociais aí implicados, valendo-se ainda da metodologia proposta por Alda Facio para análise do fenômeno jurídico. Procuramos desvendar, a partir daí, no âmbito da filosofia do direito, os reflexos produzidos pela postura androcêntrica sobre a ciência jurídica, que historicamente conduziu à segregação não só das mulheres como sujeitos de direito, como também excluiu a expressão homoerótica da esfera protetiva que o moderno estado de direito propôs.
