  Arbitration is a way of dispute resolution that exists in most legal systems.  Its analysis shall be grounded on its capacity to apply the law and to pacify society, within a context of access to justice. Through arbitration, due to some of its characteristics, it is possible to promote the distribution of justice in a faster and more effective manner, achieving some of the social expectations regarding a fair legal system.

  Arbitragem é uma forma de resolução de conflitos que está presente em grande parte dos sistemas jurídicos. Deve ser analisada na sua função de aplicar o direito e pacificar a sociedade, dentro de um contexto de acesso à justiça. Por meio da arbitragem, em razão de algumas das suas características, é possível promover a distribuição da justiça de forma mais rápida e efetiva, realizando plenamente algumas das expectativas da sociedade de acesso a uma ordem jurídica justa.
