Resumen de Una sombra en la noche: en torno al constitucionalismo gaditano y la nueva Granada

El presente texto abordará el tema de las relaciones entre el constitucionalismo gaditano con la Nueva Granada a partir de cuatro puntos: (i) la pertinencia de otra reflexión más sobre las conexiones entre la Constitución gaditana con América, en general, y con la Nueva Granada, en especial, dentro del contexto de las fiestas bicentenarias; (ii) el tipo de relación acontecida entre la Constitución de Cádiz y las constituciones neogranadinas del período de la independencia, en especial con las de la primera república (1811-1815); (iii) el valor normativo que tuvo la Constitución de Cádiz en diferentes provincias de la Nueva Granada, concluyendo que cualquier respuesta a la mencionada cuestión no puede caer en absolutos, de negro o blanco, pero sí en una amplia tonalidad de grises; (iv) las diferentes miradas que recibió la Constitución de Cádiz durante la guerra de independencia en la Nueva Granada.
Finalmente se concluirá que la Carta gaditana no puede ser considerada, sin más, como la primera Constitución colombiana, aunque sí lo haya sido para el Virreinato de la Nueva Granada.

This paper will address the issue of relations between the Constitution of Cadiz with the New Granada from four points. (I) The relevance of another reflection about the connections between the Constitution of Cadiz with America, in general, and New Granada, in particular, within the context of the bicentennial celebrations. (II) The type of relationship that took place between the Constitution of Cadiz and the constitutions of the independence's period, especially with the ones of the first republic (1811-1815). (III) The normative value that had the Constitution of Cadiz in different provinces of the New Granada, concluding that any answer to the above question may not fall on absolutes, black or white, but in a 312 wide shade of gray. (IV) The different looks that received the Constitution of Cádiz during the war of independence in the New Granada.
It will finally conclude that the Constitution of Cadiz cannot be considered as the first Colombian Constitution, although it has been for the Viceroyalty of the New Granada.
