The meaning of discourse is essentially an invitation to a dialogue among social historian, law historian, and lawyer, a dialogue which should direct in a recovery of the legal basis to the large table of that rich designer of colors and tones that is the �new historian�. In the background is the belief that the law is one of the threads that naturally inserts itself on the nerves of the fabric of a civilization. The invitation, the recovery, in these general methodological terms, has a foundation and accuracy, but demands to be verified in the reality of the various historical settings, measured in the role that the law has actually played in societies and cultures.

O sentido do discurso é substancialmente o convite a um diálogo entre historiador social, historiador do direito e jurista, um diálogo que deveria aproar em uma recuperação do jurídico à grande mesa daquele desenhista rico de cores e de tons que é o �novo historiador�. No fundo se encontra a convicção de que o direito é uma das tramas que naturalmente se inserem nos nervos do tecido de uma civilização. O convite, a recuperação, nesses termos metodológicos gerais, tem uma fundação e exatidão, mas exige ser verificado na concretude dos vários ambientes históricos, ser medido no papel que o direito tem efetivamente desempenhado nas sociedades e culturas.
