Resumen de Los efectos directos de la declaración del concurso en la esfera patrimonial del deudor: administración y disposición de sus bienes y continuidad en su actividad productiva

En este trabajo se estudian los efectos producidos por la declaración de concurso sobre el patrimonio del deudor, entendido como masa activa o patrimonio concursal. Esos efectos son distintos si el concurso es voluntario o es necesario, pero en ambos casos consisten en una restricción legal de las facultades de administracción y disposición del deudor sobre su patrimonio. Si el concurso es voluntario, la restricción legal consistirá en limitar dichas facultades del deudor, siendo los administradores concursales quienes completen esa limitación interviniendo la actuación del deudor. Y si el concurso es necesario, la restricción legal consistirá en suspender totalmente las facultades patrimoniales del deudor, siendo los administradores concursales los que le sustituyan en el ejercicio de aquéllas.

The effects produced on the inheritance of the debtor by the declaration of the creditor's meeting are studied in this type of work, understood as active mass or heritage of the creditor¿s meeting. These effects are different if the creditor's meeting is voluntary or necessary, but in both cases they consist in a legal restriction of administration's power and disposition of the debtor on his heritage. If the creditor¿s meeting is voluntary, the legal restriction will consist of limiting the mentioned power of the debtor, at the same time, the administrators are to complete that limitation, controlling the action of the debtor, and if the creditor¿s meeting is necessary, the legal restriction will be to fully suspend the debtor's economic powers, being the administrators who replaced him in the exercise of that one.
