    Llevamos varios años trabajando en el ámbito de la mediación -desde la perspectiva del trabajo académico e investigador-. Son muchas las horas que hemos compartido con mediadores y operadores y creemos firmemente en las bondades de la mediación como forma de gestionar los conflictos en muy diversos ámbitos. Desde el escolar al sanitario, pasando por el familiar, el intercultural, el laboral, el comunitario y otros. Somos conscientes de los recelos que despierta la aplicación de la mediación al ámbito penal, pero los excelentes resultados obtenidos en este contexto están consiguiendo minar el escepticismo inicial. En el trabajo que presentamos queremos poner de relieve precisamente que junto a la pena, hay otras formas y estrategias de desarrollar el control social. Nos ocuparemos del concepto y los principios mediación penal, para centrarnos después en algunas áreas susceptibles de aplicarse la mediación penal: mediación penal de menores y mediación penitenciaria. Continuaremos examinando algunas áreas controvertidas para la aplicación de la mediación penal haciendo especial referencia a los casos de violencia de género. Terminaremos exponiendo algunas críticas que se han vertido sobre la mediación penal

    We take several years working in the environment of the mediation-from the perspective of the academic work and investigator. They are many the hours that we have shared with mediators and operators and we believe firmly in the kindness of the mediation like form of negotiating the conflicts in very diverse environments. From the scholar to the sanitarium, going by the relative, the intercultural, the labor one, the community one and others. We are aware of the mistrust that he/she wakes up the application from the mediation to the penal environment, but the excellent results obtained in this context they are being able to mine the initial scepticism. In the work that we present we want to in fact put of relief that next to the pain, there are other forms and strategies of developing the social control. We will be in charge of the concept and the principles penal mediation, to center us later in some susceptible areas of being applied the penal mediation: penal mediation of smaller and penitentiary mediation. We will continue examining some controversial areas for the application of the penal mediation making special reference to the cases of gender violence. We will finish exposing some critics that have spilled against the penal mediation.
