Conflictes coparentals, via contenciosa i mediació

    La recomanació 98(1) del Consell d’Europa, sobre l’ús de la Mediació Familiar està vinculada directament a la incapacitat de l’administració de justícia per aportar solucions satisfactòries a las famílies, en el moment del divorci conjugal. La mediació és més que no un recurs, una urgent necessitat de las famílies i, per tant, de la societat, i entre les raons trobem el caràcter heterocompositiu de la legislació, la pobre cultura de divorci dels operadors i dels ciutadans, la impossibilitat de que en el procés judicial s’elaboren els aspectes intangibles del divorci, etc. La implementació de la mediació està produint un canvi en la nomenclatura dels processos de divorci, des dels termes rígids de la cultura patriarcal a altres en els que es contempla la corresponsabilitat d’ambdós progenitors en la redefi nició dels vincles coparentals. La mediació rescata l’autonomia dels cònjuges, la qual cosa els ajuda a ser més competents per a negociar i acceptar els interessos de l’altre, es a dir, negociar de manera col·laborativa.

    Recommendation 98 (1) of the Council of Europe on the use of the Family Mediation is linked directly to the incapacity of the justice administration to contribute to satisfactory solutions to the families at the moment of the conjugal divorce. The mediation it is more than a resource, it is an urgent necessity of the families and, therefore, of the society, between the causes we found the heterocompositive character of the legislation, the poor culture of divorce of the operators and the citizens, the impossibility of which in the judicial process they are elaborated intangible aspects of the divorce, etc. The implementation of the mediation it is producing a change in the nomenclature of the divorce processes, from the rigid terms of the patriarchal culture to others in which the corresponsibility of both progenitors in the redefi nition of the coparental bonds is contemplated. The mediation rescues the autonomy of the spouses, which they aid to be more competent to negotiate and to accept the other interests, that is to say, to negotiate of colaborative way.
