    Este trabajo tiene como objetivo el desarrollo y las críticas que ha recibido la tesis de la distinción entre los derechos y sus garantías, perteneciente a Luigi Ferrajoli. El núcleo central de esta tesis consiste en sostener la distinción conceptual entre los derechos y sus garantías, y señalar que el nexo que liga al derecho con su garantía no es óntico sino deóntico. En este sentido, se examinan tanto los principales aportes generados en torno a estas discusiones, como la relevancia que ellos adquieren dentro de la teoría del derecho.

    This work aims at the development and the criticism the thesis of the distinction between rights and their guarantees, belonging to Luigi Ferrajoli, has received. The core of this thesis is to support the conceptual distinction between rights and their guarantees, and note that the nexus linking the right with its guarantees, is not ontic but deontic. In this regard, this essays examines both the main contributions generated on these discussions, as the importance they have within the theory of law.
