La excepción de inconstitucionalidad en la función administrativa

    El objetivo de este escrito se centra en la caracterización de la excepción de inconstitucionalidad y su aplicabilidad por los servidores públicos de la función administrativa, en aras de que cuando exista incompatibilidad manifiesta de una norma frente a la Constitución, el servidor asuma no sólo su deber sino su obligación constitucional, de no permitir la aplicación de la norma con menor jerarquía. El artículo busca reflexionar acerca del conocimiento de los servidores públicos frente a la excepción de inconstitucionalidad partiendo de la base de que no es aplicada por dichos funcionarios.

    Se entiende por tanto, que la excepción es aplicada con mayor éxito en vía judicial, pero pierde su eficacia en vía administrativa, traduciéndose en una contravención de la Constitución en detrimento de la consolidación del Estado Social de Derecho.

    The teleological character of the document of reflection centres on the characterization of the exception of unconstitutionality and its applicability on the public servants of the administrative function, in altars of which when manifest incompatibility of a norm exists opposite to the Constitution, the servant assumes not only his duty but his constitutional obligation not to allow the application of the norm with minor hierarchy.

    The article looks for to think about the behavior and knowledge of the public servants in front to the exception of unconstitutionality, thinking that the civil servants have a minimal application of the exception of unconstitutionality, there is understood therefore, that the exception is applied by major success in judicial way, but it loses his efficiency in administrative way, being translated in a breach against the Constitution and to the detriment of the consolidation of the Social State of Law
