    La STC 204/1992, de 26 de noviembre, impulsó la creación y desarrollo de órganos consultivos de carácter autonómico, si bien algunas Comunidades Autónomas ya habían creado sus órganos consultivos con anterioridad a esta sentencia.

    Hoy en día es general la presencia de órganos consultivos dentro del entramado del autogobierno de las distintas Comunidades Autónomas, si bien no existe una homogeneidad total entre estos órganos, ni siquiera se ha hecho una traslación exacta del modelo del Consejo de Estado. Las recientes reformas estatutarias han profundizado, en cierta manera, en la heterogeneidad de estos órganos.El autor aborda la posición institucional de estos órganos a la luz de las novedades en el ordenamiento jurídico desde diversas perspectivas. Primero identificando los elementos distintivos, especialmente en lo tocante a las competencias. En segundo lugar analiza los rasgos comunes que, no obstante las diferencias, permiten afirmar que nos encontramos ante una misma institución y las notas esenciales que caracterizan su actuación. Finalmente, a partir de esta caracterización, se identifica la posición institucional de estos órganos donde la autonomía orgánica y funcional son elementos esenciales.

    Judgement of Constitutional Court no. 204/1992, of 26th November, brought about the creation and development of consultative organs of an autonomous nature, although some Autonomous Regions had already created their consultative organs prior to this ruling.

    Nowadays it is general practice to have consultative organs within the framework of the self-government of the different Autonomous Regions, although there is no complete homogeneity between these organisms and no exact translation has even been made of the Council of State model. The recent statutory reforms have, in a way, probed deeply into the heterogeneity of these organs.

    The author deals with the institutional position of these organs with regard to the recent changes in the legal order from diverse perspectives. Firstly, he identifies the distinctive elements, especially those related to competences. Secondly, he analyses not only the common features which, despite the differences between them, enable us to affirm that we are dealing with the same institution but also the essential notes which depict its acts. Finally, from this depiction, the institutional position of these organs is identified, where organic and functional autonomy play vital parts.
