En este trabajo se expone el contenido de la Directiva 2003/86/CE relativa al derecho a la reagrupación familiar de los nacionales de terceros países en el marco territorial de la Unión Europea y su paralelismo con lo que, para el ordenamiento español, establece la normativa autónoma sobre extranjería. La Directiva 2003/86/CE establece normas comunes sobre el ejercicio del derecho a la reagrupación familiar de los nacionales de terceros países que residan legalmente en los Estados miembros.
El derecho a la vida privada y a fundar una familia, contemplado en numerosos Instrumentos internacionales ratificados por España, ha de compatibilizarse no solo con los objetivos fijados por Europa sino también con la cambiante situación nacional vista desde perspectivas plurales. Las limitaciones, requisitos y exigencias que toda normativa estatal imprime al concreto ejercicio del derecho no han de verse como obstáculos a su desarrollo efectivo si se muestran coherentes y proporcionados.

The present paper seeks to show the content of Directive 2003/86/EC on the right to family reunification, and specifically the right to family reunification by third-country nationals residing lawfully in Member States and its parallelism with what establish the Spanish legislation on immigration. Directive 2003/86/EC setting out common rules on the exercise of the right to family reunification by third-country nationals residing lawfully in Member States.
The right to the private life and to create a family, contemplated in numerous international treats ratified by Spain, should be harmonized not only with the objectives set by the EU but also with the changing situation at the Spanish national in different levels. The limitations, requisites and demands that every national regulation sets to the concrete exercise of this right should not be seen as obstacles to their effective development if shown coherent and well-proportioned.
