Partiendo de una visión global del fenómeno, se estudia la naturaleza de los distintos tipos de intereses presentes en los conflictos colectivos y el cauce utilizado por el legislador para su tutela jurisdiccional, analizando especialmente los intereses individuales plurales u homogéneos propios de los procesos de conflictos colectivos divisibles y la función positiva o prejudicial de la sentencia firme sobre el fondo que les pone fin como opción legal y jurisprudencial para garantizar su eficacia sobre los posteriores procesos individuales. También se examina la sentencia de condena genérica como alternativa al art. 158.3 LPL por la que ha optado la LEC para la tutela de este mismo tipo de intereses respecto de los consumidores y usuarios.
From a global standpoint of this issue, we study the nature of the different types of interests in the labor class actions and the procedure established by the legislator for its judicial protection, analyzing specially the plural or homogeneous individual interests, a speciality of the labor divisible class action proceedings, as well as the collateral estoppel arisen from the firm judgment on the merits as legal and case law option in order to guarantee its effectiveness on the future individual proceedings. We also analyze the decision containing a generic sentence as alternative to article 158.3 LPL chosen by the Spanish Civil Procedure Law in order to protect the same interests regarding end users and consumers.
